Nuana - The Litigation Wellness Companion

By accessing and using Nuana, you acknowledge and agree to comply with these Conditions of Use. These conditions are designed to ensure safe, appropriate, and effective use of the Litigation Wellness Companion while protecting both you and the integrity of the service.
SaMD Classification & Medical Device Status
Nuana is classified as Software as a Medical Device (SaMD) with dual-level functionality:
- Level 1 (General Wellness): Mood tracking, journaling, breathing exercises, and affirmations are general wellness features not intended for diagnosis, treatment, or prevention of disease.
- Level 2 (Screening Tools): Validated screening instruments (GAD-7, PHQ-9) provide informational scores only. These are NOT diagnostic tools and do not replace professional clinical assessment.
Nuana is NOT:
- A diagnostic medical device
- A treatment or therapy platform
- A substitute for licensed mental health professionals
- Approved for crisis intervention or emergency mental health care
- Suitable for individuals currently in mental health crisis
AI Limitations & Technology Acknowledgment
You acknowledge and accept that:
- AI-Generated Content: Nuana uses artificial intelligence (Google Gemini) to generate responses. AI may occasionally produce inaccurate, incomplete, or contextually inappropriate information.
- No Clinical Judgment: AI cannot exercise clinical judgment, assess nuanced situations, or replace human therapeutic relationships.
- Pattern Recognition Limits: While Nuana can identify patterns in your inputs, it cannot understand your full life context or make personalized clinical recommendations.
- Not a Therapist: Nuana is a wellness companion, not a licensed therapist, counselor, psychologist, or psychiatrist.
- Technology Failures: Technical issues, service interruptions, or data loss may occur. Nuana is provided "as is" without guarantees of uninterrupted service.
Data Handling & Privacy Conditions
Local-First Architecture:
- Your wellness data, journal entries, and chat conversations are stored locally on your device using browser storage (IndexedDB and localStorage).
- Nuana does NOT store your conversations, journal entries, or wellness check-in data on external servers.
- AI processing occurs through Google Gemini API, which processes your inputs to generate responses but does not retain conversation history beyond the current session.
- If you clear your browser data or use a different device, your local wellness data will not be accessible.
- You are responsible for backing up any important wellness data you wish to preserve.

Crisis Protocol & Emergency Conditions
⚠️ IF YOU ARE IN CRISIS OR EXPERIENCING A MENTAL HEALTH EMERGENCY, YOU MUST CONTACT EMERGENCY SERVICES IMMEDIATELY.
You agree that:
- Nuana is NOT designed for crisis intervention and cannot provide emergency mental health support.
- If you are experiencing suicidal thoughts, self-harm urges, or thoughts of harming others, you will immediately contact emergency services (911 in Canada/US) or a crisis hotline.
- Nuana cannot and will not replace emergency mental health services, crisis hotlines, or emergency room care.
- You will not use Nuana as your sole source of mental health support during a crisis.

Professional Consultation Requirements
You agree to:
- Maintain Professional Care: Continue working with licensed mental health professionals, therapists, or counselors as appropriate for your situation.
- Consult Before Major Decisions: Discuss any significant wellness insights or patterns identified by Nuana with your healthcare provider before making major life or treatment decisions.
- Medication Decisions: Never start, stop, or change psychiatric medications based solely on Nuana's suggestions. Always consult your prescribing physician.
- Legal Advice: Nuana does not provide legal advice. Consult with your family law attorney regarding all legal matters related to your case.
- Screening Results: If screening tools (GAD-7, PHQ-9) indicate elevated scores, you will seek professional evaluation from a licensed clinician.
User Responsibilities During Litigation
As a user involved in family law litigation, you acknowledge:
- Not Legal Strategy: Nuana provides wellness support, not legal strategy or case advice.
- Attorney-Client Privilege: Communications with Nuana are NOT protected by attorney-client privilege.
- Discoverability: Your wellness data stored locally may be subject to discovery requests in legal proceedings. Consult your attorney about data preservation and disclosure obligations.
- Honest Self-Reporting: Provide accurate information to Nuana for effective wellness support, but be mindful that this data may be accessible in legal contexts.
- No Coaching: Do not use Nuana to fabricate or exaggerate symptoms for litigation advantage.
Prohibited Uses
You agree NOT to use Nuana for:
- Crisis Management: Managing active mental health crises, suicidal ideation, or psychiatric emergencies.
- Diagnosis: Self-diagnosing mental health conditions or replacing professional diagnostic assessments.
- Treatment: As a substitute for psychotherapy, counseling, or psychiatric treatment.
- Medication Management: Making decisions about psychiatric medications without physician consultation.
- Legal Manipulation: Fabricating or exaggerating symptoms to gain advantage in legal proceedings.
- Third-Party Use: Allowing others to use your account or sharing your wellness data without understanding privacy implications.
- Minors: Use by individuals under 18 years of age without parental consent and supervision.
- Reverse Engineering: Attempting to extract, copy, or reverse-engineer Nuana's AI models or algorithms.
Compliance with Court Orders
You acknowledge that:
- If a court orders you to undergo mental health evaluation or treatment, Nuana does NOT satisfy those requirements.
- Court-ordered assessments must be conducted by licensed professionals designated by the court.
- If a court orders disclosure of mental health records, your locally-stored Nuana data may be subject to such orders. Consult your attorney immediately.
- Nuana cannot provide documentation, reports, or testimony for court proceedings.
- You are responsible for complying with all court orders related to mental health treatment, evaluation, or data disclosure.
Age & Capacity Requirements
To use Nuana, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Not be under guardianship or conservatorship that restricts your ability to consent to wellness services
- Be able to understand and consent to these Conditions of Use
Minors (Under 18): If you are under 18, you may only use Nuana with explicit parental or guardian consent and supervision. Your parent/guardian must review and accept these conditions on your behalf.
Modification of Conditions
We reserve the right to modify these Conditions of Use at any time. Changes will be effective immediately upon posting to this page with an updated "Last Updated" date.
Your continued use of Nuana after changes are posted constitutes acceptance of the modified conditions. If you do not agree to the modified conditions, you must discontinue use of Nuana.
We will make reasonable efforts to notify users of material changes through in-app notifications or email (if provided).
Severability
If any provision of these Conditions of Use is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Conditions of Use, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and Nuana regarding your use of the service.
